Same thing I just said on another site . . . trying is not succeeding. Why is he charged with rape if he didn't rape anyone?

I'm asking a procedural question, not advocating less punishment. Why, if he did not succeed in raping someone, is he charged with rape? We don't charge unsuccessful killers with murder; they get "attempted murder."
