End preferences, court tells SMUD [CA]

End preferences, court tells SMUD
Plan to help minority contractors is found at odds with Prop. 209.

In a decision that could reverberate statewide, a state appeals court on Tuesday told the Sacramento Municipal Utility District that it must scrap a program giving financial breaks to some minority contractors. The ruling is the first to interpret a key exception to Proposition 209, the 1996 initiative that banned government affirmative action programs.

SMUD had argued that because its own studies showed a past pattern of discrimination against some minority contractors, it was required under federal law to solve the problem by giving the affected groups a special edge.

Proposition 209 does allow race or gender preferences when needed to maintain eligibility for federally funded programs, and that was the language SMUD relied on in designing its minority contracting program.

SMUD is crawling with leftist liberals. They stole most of El Dorado County's water with about 10 dams by building us one for a token. We weren't very developed at the time and very short sighted. Now we have to pump water back uphill out of Folsom Reservoir since the Commercial Rafting/GANG-GREENS have fought all further dams to a standstill.

So now we're high and dry but soon to be in a CONswervancy!!!

Oh! I saw on the news tonight that AS vetoed a whole slew of bills. One of which was to force more walking and bicycling to work. Do you have a list of his veto prowess, so far???
