True, but my understanding that to be illegal the ad would have to endorse a candidate...If you really look at the ad it never even mentions an election...let alone naming a candidate.

Not according to the FEC website. If the purpose of the ad is clearly to "affect a federal election", and he cannidate is clearly identified (a picture is surely good enough) then it's banned. (after Sept 3rd that is, not now) The First Amendment not withstanding.
