This would not work. It's virtually impossible to get a preliminary injunction to prevent alleged defamation even in commercial speech cases, much less a case involving political speech. An injunctive remedy would not be available. I wonder whether these threatened lawsuits would even be based on defamation. If so, then any media outlet would laugh them off - they all have top notch defamation/1st amendment attorneys on retainer and they know a successful defamation case would be impossible. No, I wonder if these cases are somehow based on the CFR statutes or some other type of technicality.

Haven't the television stations successfully refused anti-abortion ads in the past?

And, can't the swift boat vets sue the television stations themselves if their ads are refused?
