What very often happens in trials using psychiatric testimony is that both sides put their respective shrinks on the stand saying opposite things. After all that expense, the jury disregards all that testimony. But if one side can argue their case for sanity or insanity more convincingly, that side very often wins.

Back to the case before us.

Refer to post 164 and scroll down to (3)(b)(i-ii). Hacking killed two persons [see post 164, (1)(b)] and, as the statute is written and as I construe it, it wouldn't matter legally if he didn't know she was with child. Unless I'm misconstruing the statute and case law says otherwise, defense is carrying a large burden here.

I agree the perp doe not have to know of the pregnancy.
