YERINGTON - Criminal charges will not be filed in the shooting death of 43-year-old Walter Nelson Ball III of Silver Springs, Lyon County District Attorney Leon Aberasturi said Friday.

Aberasturi said the killing of Ball was justified under Nevada Revised Statutes and relevant case law. Aberasturi made his determination Friday after having been presented with the case on Monday.

Investigator Rob Hall, said the sheriff's investigation "clearly indicated the victims were in fear for their lives. The facts and the circumstances of this case are that the shooting was a justifiable homicide."

The death of Walter Nelson Ball Jr. has been determined to be justified under Nevada law, and no charges will be filed, Lyon County authorities said Saturday.

Investigators had said weeks ago that they did not think authorities would recommend any of his children face criminal charges in the death of the 43-year-old Silver Springs man, also known as Walter Nelson Ball III.

“The investigation clearly indicated the (victims) were in fear for their lives,” a statement issued by the county sheriff’s office said Saturday. “The facts and circumstances of this case are that the shooting was a justified homicide.”
