CHICAGO -- Today, three nursing home residents filed a class action complaint in U.S. District Court in Chicago against the Director of the Illinois Department of Public Aid. The suit alleges the defendant fails to ensure that nursing homes provide their residents with motorized wheelchairs when needed to ensure the residents= independence of movement. This failure violates the Americans with Disabilities Act, the Medicaid provisions of the Social Security Act, and Section 504 of the Rehabilitation Act.
The plaintiffs are three young men, two with quadraplegia and one who experienced a stroke, who live in Medicaid-funded nursing homes. Confined to their beds virtually all the time, the men eat in their beds and bathe only twice a week. They cannot visit friends or family or go outside for a breath of fresh air. Without a motorized wheelchair, they have no hope of accessing the rehabilitative and social services they need to leave the nursing home and live on their own. Medicaid recipients are eligible for motorized wheelchairs when medically necessary. However, even though specialists at prominent Chicago rehabilitation hospitals have found that the men need and would benefit from a motorized wheelchair, they have been denied these chairs solely because they live in a nursing home. The plaintiffs are represented by lawyers from Access Living and disability-rights attorney Stephen Gold of Philadelphia. The case is titled Jackson v. Maram.
One of Access Living's core goals is to end the unnecessary segregation of people with disabilities in nursing homes and institutions. In 1999, the U.S. Supreme Court made this goal the law of the land in its landmark decision, Olmstead v. L.C., which declared that unnecessary institutionalization of people with disabilities violates their civil rights. Unfortunately, four years later Illinois has made little progress in reversing its stark bias toward institutional services. Last year, Illinois spent nearly three times as much on nursing homes as it did on in-home services, resulting in the unnecessary, expensive and unwanted placement of thousands of people with disabilities in nursing homes. Policies and practices that deny nursing home residents motorized wheelchairs encourage this trend. When a person cannot leave his or her bed due to his or her inability to secure a motorized wheelchair, he or she has little to no hope of furthering, in the words of the Supreme Court, Afamily relations, social contacts, work options, economic independence, educational advancement, and cultural enrichment" -- the denial of which formed the basis for the Court's Olmstead decision.
According to Monica Heffner, a community re-integration counselor with Access Living who helps people with disabilities leave nursing homes and access community services, the three plaintiffs are not the only victims of this policy and practice. "There are many other nursing home residents who can not move independently and can not leave their nursing home without a motorized wheelchair," said Ms. Heffner. Karen Tamley, Access Living's Director of Programs, additionally said, "The laws are intended to ensure that people with disabilities have access to services that empower us to become independent. We will not achieve independence until the laws are enforced." The plaintiffs will ask the court to certify a class of all similarly-situated nursing home residents in Illinois.
Governed and staffed by a majority of people with disabilities, Access Living is Chicago's only center for independent living. It works toward the full equality, inclusion and empowerment of all people with disabilities.

LATEST WND story -- Terri's parents allowed to visit daughter: 'She was so excited to see us'
We heard so many conflicting stories and they didn't prove anything. The Clearwater Police exonerated the entire Schindler family and it's a ruse by HINO's legal team to intimate that they are still suspicious of Terri's family, just cuz. Scott Swope is a sissy looking, translucent attorney with no hint of personality. I bet he's getting a pretty penny to help "protect" Terri from being allowed to live.

If they were deposed, they would have an opportunity to "make corrections" and initial them on a draft copy of a transcript. I'm not sure if they are given that opportunity in testimony on the stand. I've only seen testimony from depos corrected and initialed. It's also the middle of the night - why am I up? lol
