To All.

'..precedent setting decisions must be identified, analyzed and documented in such a manner as to establish, beyond any doubt, they represent the personal whims and fancies of the judge or judges who have created them...'

'Indeed, precedent setting decisions of the court, which are not in harmony with the intent with which the people have adopted an article, section or clause of their state or federal constitutions, have been the most perfidious vehicle by which the court has engaged in a silent subjugation of our constitutional system…a system intentionally adopted by the people to protect themselves from folks in government!'

I was wondering...

Is this another example of what you are saying here? This appears to me to be what they call legislating from the bench:

'...WHEREAS it has come to the attention of the Court that ***there exists a potential [potential? real or imagined?] problem concerning the **safeguarding of guardianship assets; and

WHEREAS ***the Court has in conjunction with members of ****THE BAR formed a solution to the problems; it is hereby

ORDERED AND ADJUDGED that effective November 1, 1994, all liquid assets belonging to a ward who is the subject of a guardianship proceeding in this Court and which are to be gathered and placed in a ***designated financial institution pursuant to §69.031, Florida Statutes, for the benefit of that ward are to ***first only be paid to the trust account of **the attorney for the guardianship who shall then be responsible for placing those funds in the appropriate designated financial institution. 'INTRODUCTION

This document records the official surrender, on June 7, 1949, of FLORIDA's third branch of government, the Supreme Court of Florida, to a private professional trade group formerly known as the Florida State Bar Association and now known as The Florida Bar. This government takeover set the stage for the present day graft and corruption now found in Florida's judicial system....'

Along with that see this: UPL [Unauthorized Practice of Law - I don't know yet but suspect this would include oneself attempting to defend oneself in a Court of 'Law' if oneself were not a member of the BAR, which pledges a secret oath to uphold our 'debt' to the bankruptcy of the corporate United States of America, which was engineered by the city of London and the International Banksters.] VIOLATION TO GO FROM MISDEMEANOR TO ***FELONY

'SB 1776, sponsored by Senate Judiciary Committee Chair Alex Villalobos, R-Miami, would raise the penalty for violating the states Unauthorized Practice of Law UPL from a first-degree misdemeanor to a third-degree felony, which can be prosecuted by the State Attorney ' [would this be the same State Attorney which does not prosecute Michael Schiavo and George Greer for their violations of the guardianship law, and who would allow, no, by acquiescance, demand that Terri be murdered by these two to comply with some contrived 'right to privacy', whilst the doors of your home are kicked down to look for contraband and guns, or agents of the Banksters sneak into your home to have a peek at what you've stashed in your closet or on your computer, and police pull your car over under the guise of checking your seatbelt and proceed to pat you down with your legs spread and your hands over your head, and search your car, whilst you are strip-searched at an airport even though you are an 8-year old, blue-eyed grandma?] 'The bill had passed the Senate Judiciary Committee with minimal discussion and a unanimous vote. If approved, the new law would become effective July 1, 2004. In the House, Rep. Jeff Kottkamp, R-Cape Coral, chair of the House Judiciary Committee, plans to bring the issue there in a proposed committee bill. The Florida Bar is supporting a bill to increase penalties.

The difference would mean tougher punishment. A first-degree misdemeanor is punishable by up to one year in jail and up to $1,000 in fines. A third-degree felony is punishable by up to five years in prison and $5,000 in fines.

The Bar supports this legislation -- of course not to get business for the lawyers, but "to protect the people who are suffering irreparable harm. We recognize our obligation to protect Floridians from the unlicensed practice of law, and we need the state prosecutors to help us resolve this problem" says Miles A. McGrane III president of the Florida Bar. ' http://www.judicialaccountability.org/alerts.htm .

Ooops. Sorry for that jumbled post. I was working on a longer reply, and had meant to break it down on two separate posts. My daughter kept interrupting me to go to MickeyD's for an egg mcmuffin, and I appear to have gotten the two mixed up. Now to go make sense of what I did. BTW, it wasn't until I had pushed the post button, that it hit me what I had posted regarding the Judges deciding with the BAR, to put the guardianship money in the lawyers' accounts. I think that's it. I think that's what'd behind this. That would be typical of them. Write some innocuous-looking edict that gives them all the control and all the dough. And with all the elderly in Florida, it would be a steady stream of income. It's still dawning on me. Am I right?? If so, don't thank me, thank God, because I only found that by accident, and didn't realize the whole ramifications until I sent it on its way.
