It's a violation of the Geneva Conventions to hold a prisoner up to ridicule or even to photograph one in such a manner as to reveal his/her identity. CNN and a few others have been blurring the prisoners' faces and that is OK. The New Yorker and Seymour Hersh have not. Anyone can commit a war crime, not just a member of the military or command structure -- even civilians. Arguably, by releasing photos that show the prisoners' faces without blurring them (such as the photo showing the prisoner surrounded by the dogs) the New Yorker is itself committing a war crime.
