Memos show Gorelick involvement in 'wall'

"It is hard to be totally comfortable with instructions to the FBI prohibiting contact with the United States Attorney's Offices when such prohibitions are not legally required," U.S. Attorney Mary Jo White wrote Ms. Gorelick six years before the 2001 terrorist attacks in New York and at the Pentagon.

"Our experience has been that the FBI labels of an investigation as intelligence or law enforcement can be quite arbitrary, depending upon the personnel involved and that the most effective way to combat terrorism is with as few labels and walls as possible so that wherever permissible, the right and left hands are communicating," she wrote.


Newly released Justice Department memos show that September 11 panel commissioner Jamie S. Gorelick was more intimately involved than previously thought with hampering communications between U.S. intelligence and law-enforcement agencies fighting terrorism.

As the No. 2 person in the Clinton Justice Department, Ms. Gorelick rejected advice from the U.S. attorney for the Southern District of New York, who warned against placing more limits on communications between law-enforcement officials and prosecutors pursuing counterterrorism cases, according to several internal documents written in summer 1995.

"It is hard to be totally comfortable with instructions to the FBI prohibiting contact with the United States Attorney's Offices when such prohibitions are not legally required," U.S. Attorney Mary Jo White wrote Ms. Gorelick six years before the 2001 terrorist attacks in New York and at the Pentagon.

The documents -- released yesterday by the Justice Department at the request of two Senate Republicans -- drew renewed calls for Ms. Gorelick to testify publicly before the September 11 commission about the so-called "wall" between law enforcement and intelligence agencies that many have blamed for allowing the 2001 terrorist attacks to occur.

Sen. John Cornyn, Texas Republican, said yesterday that Ms. Gorelick's policies regarding the wall contributed to "blinding America to this terrible threat."

Also, he said, the newly released memos raised apparent conflicts with statements Ms. Gorelick has made recently defending herself and her role in the Clinton Justice Department.

"These documents show what we've said all along: Commissioner Gorelick has special knowledge of the facts and circumstances leading up to the erection and buttressing of 'that wall' that, before the enactment of the Patriot Act, was the primary obstacle to the sharing of communications between law enforcement and intelligence agencies," Mr. Cornyn said.

In a June 19, 1995, memo, Ms. White recommended a series of changes to a Gorelick policy that went beyond legal requirements in separating law- enforcement and intelligence agencies.

For instance, Ms. White said the local U.S. Attorney should be notified as soon as "criminal law enforcement concerns exist" while investigating terror suspects.

Deputy Director Michael Vatis rejected her recommendation.

"Notifying the [U.S. Attorney] as soon as law enforcement concerns exist -- but before [the criminal division] thinks that the investigation should 'go criminal' -- is simply too early," wrote Mr. Vatis, who was concerned that Ms. White's proposal could result in "prejudicing a possible criminal prosecution."

In a handwritten note to Attorney General Janet Reno, Ms. Gorelick wrote, "I have reviewed and concur in the Vatis/Garland recommendations for the reasons set forth in the Vatis memo."

The extent of Ms. Gorelick's involvement, spelled out in these memos, in buttressing the law enforcement-intelligence wall also raises questions about statements she has made recently defending herself and distancing herself from the decisions about the wall.

Asked by CNN's Wolf Blitzer earlier this month about whether she had written a memo helping establish the wall, she replied: "No, and again, I would refer you back to what others on the commission have said. The wall was a creature of statute. It's existed since the mid 1980s. And while it's too lengthy to go into, basically the policy that was put out in the mid-'90s, which I didn't sign, wasn't my policy by the way, it was the attorney general's policy, was ratified by Attorney General Ashcroft's deputy as well in August of 2001."

Also yesterday, another group of Republican senators pressed their case for Ms. Gorelick to testify publicly and poked a hole in the reason the commission has given for not calling her.

Last week the commission's leaders received a letter from 11 Republican senators, led by Sen. Christopher S. Bond of Missouri, calling on Ms. Gorelick to testify in public.

The panel refused, saying that commissioners have only called former and current attorneys general and FBI directors to talk about the intelligence-law enforcement division, not their deputies.

They specifically listed four Justice Department deputies they did not call to testify, including Larry D. Thompson, a onetime deputy to Mr. Ashcroft.

But in a letter back to the commission yesterday Mr. Bond and his colleagues said Mr. Thompson, who is now a senior fellow at the Brookings Institution, did in fact publicly testify about his time as deputy, and commission records include a transcript and video archive of his testimony.

"Even before the horrific events of September 11, I witnessed firsthand, as the deputy attorney general, some of the problems that we in the department had with sharing information," said Mr. Thompson, who appeared before the panel on Dec. 8.

Mr. Bond and his colleagues said Ms. Gorelick has critical information she can provide about the same topic, and said her private interview with the commission is not enough.

"We believe, as was the case of [National Security Adviser Condoleezza] Rice, that public testimony by the decision-makers best serves the commission, the public, and ultimately Congress," the senators said, pointing to similar sentiments Ms. Gorelick herself expressed during the debate over Miss Rice's testimony.

"Unless Ms. Gorelick provides public testimony, like other key officials have done, there will be a significant gap of knowledge as far as what the public will know about its government prior to 9/11," they wrote.

Gorelick Memo Allegedly Impeded Probe of Clinton Fundraising Scandal

(CNSNews.com) - A senior U.S. government official has told CNSNews.com that the 1995 memo written by former Deputy Attorney General Jamie Gorelick and currently at issue in the 9/11 Commission's investigation of U.S. intelligence failures, also created "a roadblock" to the probe of the 1996 Clinton re-election campaign fundraising scandal.

The memo's relevance in the investigation of the fundraising scandal has received scant attention in the media, but four different sources, including the government official, have explained and corroborated details of the connection for CNSNews.com.

The CNSNews.com sources question whether the guidelines purportedly put in place by Gorelick in 1995 for Justice Department investigations were actually intended to shield President Bill Clinton, Vice President Al Gore and top Democratic campaign fundraisers from the subsequent congressional investigations of the illegal fundraising activities.

However, there appears to be no evidence at this point that the Gorelick memo was written for that express purpose.

Because the memo created a barrier for U.S. intelligence agencies to share information with the FBI, one of its unintended consequences may have been to prevent the FBI from receiving the necessary intelligence to stop the Sept. 11, 2001 terrorist attacks, the worst in American history.

Memo's link to fundraising scandal

The fundraising investigation involved the Clinton campaign's alleged acceptance of donations from operatives working for the People's Republic of China (PRC) as well as other foreign sources. But the Gorelick memo of 1995 prevented intelligence collected by U.S. agents overseas from being used in domestic criminal investigations.

Peter M. Leitner, a long-time employee at the Department of Defense and currently a senior strategic trade advisor at DoD, was responsible at one point for deciding whether to issue a license to a Chinese corporation seeking to buy a McDonnell Douglass machine tools factory.

At the same time, according to congressional investigations of the fundraising controversy, the Clinton campaign was receiving millions of dollars in donations from Chinese businessmen.

Leitner told CNSNews.com that he repeatedly saw investigations that would have led directly to foreign agents stymied by the wall erected by Gorelick in her 1995 memo.

"The Gorelick memo guidelines created a firewall that protected the [Clinton] administration" from the Justice Department's investigation into foreign campaign donations, Leitner said.


Gorelick's previously classified memo became public when Attorney General John Ashcroft sought to defend the Bush administration in recent testimony before the commission studying the intelligence breakdowns in the months leading up to the Sept. 11, 2001 terrorist attacks. Among those listening to Ashcroft's testimony about the memo he had just released was Gorelick, herself a member of the 9/11 Commission.

"The simple fact of September 11th is this," Ashcroft told the commission. "We did not know an attack was coming because for nearly a decade our government had blinded itself to its enemies. Our agents were isolated by government-imposed walls."

Another DoD official, who requested anonymity, explained in an interview with CNSNews.com that, "the PLA (People's Liberation Army) used front companies to buy U.S. defense high technology and influence in the U.S. government." In many cases, the source said, "the operatives were dealing directly with the White House."

That type of intelligence might have been used in the prosecution of high-profile figures such as former Commerce Department official and Democratic National Committee fundraiser John Huang, as well as long-time Clinton associate Charles Yah Lin Trie, and ultimately may have led directly to President Clinton and Vice President Gore, sources said.

According to congressional investigations, Huang and Trie maintained close relationships with Beijing after Clinton was elected in 1992 and especially as they became major fundraisers for Clinton's 1996 re-election campaign and the legal defense trust fund established for the president and First Lady Hillary Clinton to fend off charges associated with the Whitewater controversy.

"It was a classic spy network, nothing exotic about it," Leitner told CNSNews.com . "It included compromised public officials paid off with illegal campaign contributions." But Leitner said it was frustrating to see Huang and Trie eventually plea-bargain "for petty offenses instead of being investigated for espionage."

Leitner testified five times before congressional committees attempting to get to the bottom of what ultimately became known as the China/DNC fundraising scandal. The Clinton administration Justice Department, headed by Attorney General Janet Reno, also conducted an investigation, even though many people accused the department of having a conflict of interest.

Chinese weapons development and smuggling

Leitner said one of the most important investigations hindered by the Gorelick memo involved a Chinese state-owned corporation's activities after it had purchased a McDonnell Douglass high-tech machine tools factory in Columbus, Ohio.

The factory, known as Plant 85, had previously been used to manufacture the bodies of U.S. Air Force C-17 strategic transport planes and MX intercontinental ballistic missiles.

In 1994, the China National Aero-Technology Import and Export Corp. (CATIC) offered to buy Plant 85 from the financially troubled McDonnell Douglass Corporation and relocate it to China where CATIC officials said it would become a civilian aircraft-production facility, according to court documents.

The sale required a government export license, which Leitner was in charge of either approving or denying. Leitner denied the license, arguing that once the machine tools from Plant 85 were exported to the People's Republic of China, they would be used to produce missiles for China's People's Liberation Army as well as nations unfriendly to the United States.

Leitner was eventually overruled, but according to court documents, within months of the plant being exported to China, U.S. officials learned that the sensitive machine tools had been diverted to a Chinese factory manufacturing Silkworm missiles.

Leitner told CNSNews.com that he informed the federal prosecutor in the case that the CATIC license was approved over his objections because of "pressure from Vice President Gore." That testimony, however, was never heard in court.

A criminal investigation was launched in 1995, but Reno resisted calls from congressional Republicans to appoint an independent counsel in the case. Instead, she named career prosecutor Charles LaBella to head up the Justice Department's own task force investigating President Clinton and the sources of the foreign contributions.

LaBella acknowledged that the wall established by Gorelick was "cumbersome" to the investigation but that he was ultimately able to work around it.

"Clearly there was a line between the criminal and the counter-intelligence side," he said. LaBella added that one of the Senate committees was frustrated because "briefings from intelligence didn't match up with the criminal investigations."

After LaBella's work was completed, he recommended the appointment of a special prosecutor, an idea Reno again rejected. In the end, indicted suspects in the investigation, including CATIC and McDonnell Douglass, were able to plea bargain for lesser offenses. The plea bargains eliminated the need for Leitner to testify about the alleged "pressure" exercised by Gore.

In another case that spanned the mid 1990s, U.S. Customs ran a sting operation against a Chinese-owned company known as Poly Technologies. The company was attempting to smuggle thousands of AK-47 automatic rifles into the U.S.

Customs agents posed as buyers for the illegal weapons and the undercover operation eventually led to the indictment of five Chinese nationals. Senior Customs Field Agent Michael Goldsmith told CNSNews.com that "there is absolutely no doubt that it (the Gorelick memo) made things tighter and tighter" in terms of "not having critical data available and not being able to use it."

"Operation Dragonfire," the name of the sting operation, ended with the indicted suspects pleading guilty to less serious weapons-related charges.

Gorelick's alleged conflict of interest

Gorelick, as a member of the 9/11 Commission, is currently fighting the perception that she has a conflict of interest since the lack of intelligence cooperation between the FBI and the intelligence gathering agencies has been widely cited as the reason for the U.S. government's inability to stop the attacks of Sept. 11.

In his April 13 testimony before the 9/11 Commission, Ashcroft said the wall was "the single greatest structural cause for Sept. 11. Government erected this wall. Government buttressed this wall. And before September 11th, government was blinded by this wall," Ashcroft told the commission.

Leitner went a step further. "What is disturbing is that that memo served to protect the administration from exposure in its dealings with the PRC and the unfortunate consequence may be the death of 3,000 Americans."

Spokesmen for Gorelick and the September 11 Commission did not respond to numerous requests from CNSNews.com for comment on this story.

It is quite clear that the agencies of government who should have been protecting us in these circumstances had not even barely contemplated this sort of event and therefore were not prepared to execute against any kind of plan and so you had massive miscommunication and failure to execute on what they needed to do.

This is a persistent question that we have had.

There seems to have been an enormous disconnect between the intelligence community and what it thought the threats were and the individuals who had to plan against given threats.

So you see the FAA utterly unprepared for--uh--not taking any steps to prevent hijacking of this sort, and you hear NORAD--that is, our military--who are supposed to protect the domestic air space, saying they were focused completely outward and had almost no capacity to protect us internally.

I would just say, though, Pete, and you've been at the Pentagon, too. You know this.

The military is pretty good as a--an intelligence consumer. And my question today for General Myers and others was, why didn't you pull into yourselves and into your own planning process a government-wide assessment of what the threats were?

And you know, John [Lehman] is right. They didn't get intelligence which said, "Focus inside." And so they were focused completely on the perimeter. And that has an enormous impact in what you're seeing in this report....

I mean, you can't fault the FAA here at all. I mean, the FAA did not have the right intelligence either.

I mean, it was not exercising against this. It had protocols as we just discussed that were not remotely appropriate to the kind of hijacking that we had, to an airplane used as a missile.

This is not the FAA's problem. This is the way in which intelligence, which was someplace in the intelligence community, did not find its way to policy makers and certainly to implementers like the FAA and like the Pentagon.

This story merits its own book, but what deserves immediate comment is the willingness of the Clintons to risk everything to keep the cash pipeline open. Schwartz kept it open and full. Before he was through, Schwartz and Loral would donate roughly $2 million to the Clinton cause. Whether Schwartz gave additional money or favors off the books is a question that deserves asking.

A second question that deserves asking is just how much damage Schwartz, Berger and the Clintons did to America's national security.

A third question worth asking is whether Ron Brown's very real threats to expose these machinations led to his death.

e would have it backwards and miss the point entirely if we were to attribute The Gorelick Wall and the attendant metastasis of al Qaeda during the clintons' watch, (which, incidentally, was then in its incipient stage and stoppable), to the '60s liberal mindset.

Rampant '60s liberalism was not the underlying rationale for The Gorelick Wall.

Rather, The Gorelick Wall was the underlying rationale for--The Gorelick Wall was (insofar as '60s liberalism was the Wall's apparent impetus) a cynical cover for --the willful, methodical malpractice and malfeasance that was the product of the virulent clinton strain of rampant '60s liberalism.

While it is true that The Gorelick Wall was the convenient device of a cowardly self-serving president, The Wall's aiding and abetting of al Qaeda was largely incidental, (the pervasiveness of the clintons' Nobel-Peace-Prize calculus notwithstanding).

The Wall was engineered primarily to protect a corrupt self-serving president. The metastasis of al Qaeda and 9/11 were simply the cost of doing business, clinton-style.

Further confirmation of the Wall-as-cover-for-clinton-corruption thesis:

  • Gorelick's failure to disclose the fact that she authored the memo that was the efficient cause of 911
  • Gorelick's surreal presence on the 911 commission investigating Gorelick's Justice Department, a maneuver that effectively removes from the universe of witnesses a central witness, Gorelick, even as it uniquely positions a central player, Gorelick, to directly shape the commission's conclusions. (Is there any question which two people are responsible for Gorelick's insertion on the commission?)

Conversely, that it never occurred to anyone on the commission that Gorelick's flagrant conflict of interest renders her presence on the commission beyond farce calls into question the commission's judgment if not its integrity. Washington's mutual protection racket writ large, I suspect.

The Gorelick Wall is consistent with, and an international extension of, two essential acts committed in tandem, Filegate, the simultaneous empowering of the clintons and disemboweling of clinton adversaries, and the clinton Putsch, the firing and replacement of every U.S. attorney extant.

Gorelick Agonistes
Her refusal to resign taints the 9/11 Commission.

Jamie Gorelick has now issued her defense for staying on the September 11 Commission, and the usual media and Democratic suspects are rallying behind her. So let's put the issue as simply as possible: If Clinton-era Deputy Attorney General Jamie Gorelick were not already a Commission member, does anybody doubt that she would be called to testify before it?

The Commission is interviewing nearly every major law enforcement and defense figure in two Administrations, and surely a Deputy AG was one of them. More than that, Ms. Gorelick was the author of a memo that has now become central to the debate over what went wrong before 9/11 in the way the U.S. dealt with terror threats.

Yet Ms. Gorelick now claims she can judge everyone else as a Commissioner....

No serious person on either side of the aisle doubts that the "wall" of separation between intelligence agents and criminal investigators... in her memo was a problem. Everyone also now agrees that poor intelligence sharing was one of the key reasons U.S. authorities failed to detect the September 11 plot....

Far from being unnecessary, Ms. Gorelick's testimony goes to the heart of the U.S. government's 1990s' failure to get its antiterror act together....

What is clear is that for some reason the nature and height of "the wall" underwent a qualitative change in the 1990s, as any investigator or prosecutor who dealt with it now says.

Whereas previous interpretations of the FISA statute had limited the ability of prosecutors to produce certain intelligence in court, the new rules effectively prohibited people from communicating at all....

[W]e won't have a clear picture until she and some of the other major players--including members of the FISA court--testify.

The 9/11 Commissioners are only undermining their own credibility in rallying to Ms. Gorelick's defense. Her conflict of interest can't be solved merely by recusing herself from discreet portions of the probe, since as a Commissioner she will still serve as judge and jury on everyone else in government. She should have recused herself entirely from even questioning John Ashcroft. We also take no comfort in Republican Orrin Hatch's endorsement, since one of Ms. Gorelick's former law partners represented him in the BCCI case and he whisked her through Senate confirmation in 1994.

The 9/11 Commission was supposed to be a fair-minded, non-partisan probe that would help our democratic government learn from its mistakes. Ms. Gorelick's failure to resign and testify herself in the face of a clear conflict of interest is reason enough for the American public to distrust its ultimate judgments.

Newly released Justice Department memos show that September 11 panel commissioner Jamie S. Gorelick was more intimately involved than previously thought with hampering communications between U.S. intelligence and law-enforcement agencies fighting terrorism.

As the No. 2 person in the Clinton Justice Department, Ms. Gorelick rejected advice from the U.S. attorney for the Southern District of New York, who warned against placing more limits on communications between law-enforcement officials and prosecutors pursuing counterterrorism cases, according to several internal documents written in summer 1995.

"It is hard to be totally comfortable with instructions to the FBI prohibiting contact with the United States Attorney's Offices when such prohibitions are not legally required," U.S. Attorney Mary Jo White wrote Ms. Gorelick six years before the 2001 terrorist attacks in New York and at the Pentagon.

"Our experience has been that the FBI labels of an investigation as intelligence or law enforcement can be quite arbitrary, depending upon the personnel involved and that the most effective way to combat terrorism is with as few labels and walls as possible so that wherever permissible, the right and left hands are communicating," she wrote.

The documents -- released yesterday by the Justice Department at the request of two Senate Republicans -- drew renewed calls for Ms. Gorelick to testify publicly before the September 11 commission about the so-called "wall" between law enforcement and intelligence agencies that many have blamed for allowing the 2001 terrorist attacks to occur.

Sen. John Cornyn, Texas Republican, said yesterday that Ms. Gorelick's policies regarding the wall contributed to "blinding America to this terrible threat."

Also, he said, the newly released memos raised apparent conflicts with statements Ms. Gorelick has made recently defending herself and her role in the Clinton Justice Department.

"These documents show what we've said all along: Commissioner Gorelick has special knowledge of the facts and circumstances leading up to the erection and buttressing of 'that wall' that, before the enactment of the Patriot Act, was the primary obstacle to the sharing of communications between law enforcement and intelligence agencies," Mr. Cornyn said.

In a June 19, 1995, memo, Ms. White recommended a series of changes to a Gorelick policy that went beyond legal requirements in separating law- enforcement and intelligence agencies.

White's 1995 memo effectively put the clinton-Gorelick cabal on contemporaneous notice that Gorelick's Wall was placing America at grave risk from terrorism.

The memo explicitly warned that the protective wall the clintons and Gorelick were busy erecting (doubtless to blind domestic law enforcement to the clintons' illegal foreign schemes) would (also) blind domestic law enforcement to terrorist plots foreign and domestic.

From this it follows that Gorelick's Wall was not the clintons' and Gorelick's simple (albeit monumental) blunder.

Rather, Gorelick's Wall was no less than the clintons' and Gorelick's malfeasance--willful, self-serving and seditious--with the metastasis of al Qaeda and 9/11 the sorry endpoint.

NOTE: Bin Laden declared war on America throughout the clintons' watch. Had the clintons understood that this was war, not crime, that a terrorist war requires only one consenting player, Gorelick's Wall would be just another clintoncorruption footnote.

How does a man with NO self-control -- Clinton -- become President of the United States? That's a primal question.

I think the answer is not that the US is so dimwit or cynically callous to elect such a man, nor that Clinton has some super-magic charisma (he doesn't, a lot, no more), but that he had a major consistently directed force applied in his direction.
