CA: Prop. 13 survives attack - again

Support for a ballot initiative that essentially would have split the property tax rolls and charged more to business and apartment owners collapsed last week - and that's good news.

Tax increase opponents discovered in the initiative a drafting error, which could have made the land on which houses are built - as distinguished from the actual houses - subject to annual reassessment. If true, homeowners would have been affected by the initiative as well as businesses.

Why did they want to raise the cost of renting versus ownership? That sounds rather foolish to me.

What is a change of "ownership" for an incorporated business or a partnership? Does the sale of a portion of the stock or percentage of the business to another party (adding a partner) trigger a property tax increase? On the other hand, you could sell a business, but keep the business real estate property and rent it back to the new owners - no "change of ownership". Or what about tranfer to a trust for estate tax purposes? As you can see, where there is a tax, the potential for loopholes surface immediately.

Exactly. They would have had a tough time passing in November for even in Democratic and liberal California, we feel overtaxed. If there's one message that came through loud and clear from the voters last month, its no tax increases. Whether the liberals will really understand is an open question: they'll keep trying to play the Class Warfare Card but ultimately the public understands their real objective to grab money from every one's wallets. At a time when businesses are leaving California in droves, killing the one source of job creation was a stupid idea. Its one of those ironies of history that bad legal draftsmanship saved us from Rob Reiner's latest project. Above all, we have to remain vigilant as the enemies of freedom never tire in their quest to undermine it.
