I could be wrong, but I believe a soldier/sailor/marine is obligated to report wrongdoing (war crimes) to his superior.
Using that method, the individual that misbehaves (commits war crimes) can be dealt with.
In this case, it isn't much different than reporting a murder. That is why they are called "crimes."
"Hello. I'm phoning in, to report a man, who just shot an unarmed woman and her child."
So following my example, I guess Kerry broke Navy regulations, for failure to report war crimes, which he had knowledge of. He was, after all, a commissioned officer.
