March 8, 2004 -- Martha Stewart's ex-husband, Andy Stewart, feared the princess of perfection's long-held habit of telling whoppers would one day trigger her downfall, a former business partner told The Post yesterday. Norma Collier, who was Martha Stewart's first business partner when they started a catering business in Connecticut in 1974, said yesterday that Stewart's self-made disaster was "very sad" - and almost inevitable.

What would have been the proper thing for Martha Stewart to do after hearing that her investment was going down the tubes?

Well, had I been Martha, and having been a broker, I would have realized that the next action I took could have been illegal.

Situational? Of course. Sentencing should almost always be "situational". The harm caused is one factor that should affect sentence.


I've had Marthy's number since the early nineties.* Yes, yes, she's a mean bean. She doesn't belong in prison for
this particular fib, however.

* She had mine long before that - she knew I didn't want to bake that six layer cake, I just wanted to look at the pictures and think about making it.

In the next hour Fox is going to interview the K-Mart executive who put the deal together with Martha Stewart. This should be interesting!

Also, this evening Frank Kostyra, her brother, is going to be on one of the cable shows.

These guys and gals who blame the government for Martha's predicament do indeed offer a twisted view of justice. Your comment above offers the most common sense I've seen injected into this Martha thing. Thanks.

No, it isn't in this case; there are strick guidelines.

Hey, did you ever buy any of her merchandise? I bought some bath rugs that faded after two washings. On the ATRW thread Two-thirds had a teakettle that broke after 2 months, and duckbutt had towels that turned to lint!!

I think this weekend I will ask people to recount their experiences with her merchandise. HA!

You wouldn't think so if you listen to all of Martha's friends on TV over the weekend; to a person, they STILL believe we are dumb and they are right, not to mention better than the rest of us.

Martha was great fun to Bill Cosby and Rosie O'Donut. She only duped and dumped on the little people in her employ. I know a woman who worked a while for her back in 1983. Martha had an increasing rep back then as a super homemaker for profit type. My friend worked in her herb garden

I was given the teapot; almost burned my hand off! Plus it SPEWED water everywhere. I gave it to Goodwill and got another Revere one!

The stuff at Kmart is NOT the stuff in her catalogs or even on the web site (I think).

K-Mart guy is acting like merchandise is still selling. I don't think he wants to go out on a limb. His wife loves her products. (Probably because she gets them for free.)

Oh, now the story is that Martha didn't really produce the stuff. She just provided direction.

Products still selling like hotcakes at K-Mart.

WoW! What a great idea! Martha Stewart could transform the prison ~ transform the prison system.

Stewart's ability to make stuff beauty out of elemental things, make the ordinary something very special; just like Chuck Coleson, this could be a transformation for Stewart that could put new life into her calling. She has already taken the suburban farm, family home, as far as it can go, this could be a great opportunity to take it to the next level, not just transforming a suburbanites life, but for those who never had anything. She has the no nonsense attitude to do it.

The judge still has a great deal of discretion in this case. He has the power and leeway under the law to inflict a range of punishments from probation to 5 years in prison.

I think she should get a prison term, and it should be suspended. On the low end, too - a year to sixteen months in the federal pen.

FWIW I am opposed to sentencing guidelines that remove judiciary discretion.

No, she does not; she can move the months DOWN considering some of the good things about Martha; contrition, as they are saying right now on Fox, MIGHT get her the BOTTOM range, but not probation. The numbers quoted on this thread already have the "down" factored into them. (Since she's neither contrite NOR admitting what she did, that's not going to help her.)

She's going to jail for at least ten months, with no chance of getting out for good behavior. There's not going to be any probation or community service for her.
