I want to know what their definition of "defective" is.

If it is that you can't clear the chamber with the safety on, then it is a set up hose job for us.

Very good point, the bill better spell out the "defective" means it literally malfunctions, an that defective can never mean a lack of "features", or the wrong shade of red for on the safety indicator, etc.
