As much as I hate to say it, this is going to take a constitutional amendment to fix this problem. No it doesn't, all it requires is a congress that will stand up to the judiciary. I would not hold my breath waiting on the current crop of leaders to take a righteous stand on anything.

Actually, if the Supreme Court ruled a law passed by congress to be unconstitutional, all the congress could do is pout. An amendment would be the only way to stand up to the judiciary.
