First off, I couldn't agree more with you on CFR.

I think pilots and co-pilots -- those in control of an airplane in flight -- should suffice.

As you know, passenger airlines are private entities, not the government. Therefore, for a passenger airline to tell its pilots to refrain from discussing religion during flight does not violate the First Amendment because there is no "state action."

There is no government involvement in this case. This guy is not being charged or investigated by the government. The only issue here is whether he violated the rules set down by his employer. This is not a 1st Amendment issue.
