Why just Pickering? He wants to keep the judicial obstruction issue alive. Pickering's old, not even that conservative, no big deal. But the others we want to make sure have life appointments.

This is good news because it shows that W is willing to play hardball with recess appointments. But before the dam breaks, there are the wishes of the various blocked nominees to consider. For example, Janice Brown might not be willing to be appointed for a single year through a recess appointment, because she's already got a pretty good for-life gig on the Calif. Supreme Court. In short, a recess appointment is only possible if the said nominees are willing to be so appointed. But, again, the good thing is that Bush is willing to make such appointments.
