Fox news said it wasn't without precedent - that clinton had done it too. Can anyone link to a specific article on clinton doing this?

I heard that too. Their consultant, Judge Napolitano, said that Clinton recess-appointed some guy named Lee to be the assistant or deputy administrator of the Civil Rights Commission. He did it twice.
