Bush names Miss. Judge Charles Pickering to federal appeals court

This is posted as breaking news on msnbc's website. Did a search and didn't see it anywhere. Nothing follows for now. Anyone know anything?

Yep. Looks like Pickering fits within the exception explained in Sec. 5503(a)(2).

See - a few people freaked out - and gave answers based upon thier emotions, but the statute does say that unless the vacancy arose with 30 days before the end of the session, a recess appointee will not get paid from the treasury if a President simply appoints him out of the blue, without ever nominating for Senate confirmation.

FOX pointed out that Billyboy Clintoon also appointed recess judges--not the same level of judges that President Bush just did--I'm not sure what the hierarchy is--but he did do the same thing.

Hmm...interesting take on it. Definetly agree with regards to Katherine Harris. Libs go nuts when she appears on the TV. I would only remark that I hope the CENTCOM meeting was done independantly of any political strategy. Its not appropriate to use our armed forces and their successes for overt political gain.

Kas, I agree! This issue has been a real sore point for me and I've been really annoyed at Frist for not finding some way to get these judges an up or down vote. Well, W, took the reins. And, I really don't care if this is to offset the immigration issue....I'm just thrilled it's been done. And, when Bush is reelected, if he needs to, hopefully, he can appoint Pickering again in 2005. The Dims deserved this.

I dont think the amnesty stuff has even started. I think plenty of repbs have called and complained about this. But think about the brilliance of Bush and Rove and how Dick Morris said that if there was a God, he surely would be in republican column. Worst economy in 20 years, and we have the best quarter in 20 years, no jobs and unemployment drops, stock market at highs, Saddam being captured, CFR, Prescription drugs, you name it, the Rats have nothing left to accuse the republicans off.. Its a series of brilliant moves even though we might not all agree with everyone of these polices but cannot think of one kitchen sink issue that the Rats can run on.

I heard that too. Their consultant, Judge Napolitano, said that Clinton recess-appointed some guy named Lee to be the assistant or deputy administrator of the Civil Rights Commission. He did it twice.

Not exactly.

The Nuke is a point of order to the VP asking for a rules clarification on filibusters. The VP rules that it can't be used for advise and consent, and the nomination goes to the floor for a vote.

That's the nuke.
