Well, the fallacy of my initial agreement with your thesis has been pointed out by both Pseudo and lrslattery (?), I think.

But there is no fallacy in simply leaving the decision to the woman and her confessor.

She would indeed need to confess it. The problem is if Church officials tell others to do it.
