Had Maryland been allowed to vote on secession and voted against it, I would not be able to say Maryland was an Occupied State.

I think the Maryland legislature did reject secession.

Walt, The Maryland Legislature did not vote on secession. Virginia diddled about before their vote to the extent that Maryland was invaded before the bills could be presented and voted upon. Maryland has a very structured legislative process, involving multiple readings of a bill in each House prior to a vote. Only under a suspension of the rules (rare!)could the process be expedited.

Maryland could not seceed without Virginia committing to secession, the position would have been militarily untenable.

Hordes escaped to Virginia, sometimes forming their own units (the First MD Volunteers was one), sometimes enlisting in existing units, but fighting for the South.

Yes, admittedly, some went for the Union, but they were the minority, and mostly from the northwestern part of the state (above the fall line).
