That dog won't hunt, it's a non justiciable issue. SCOTUS won't touch it.
It's a politcal issue to be decided through politics. The republicans simply need to find the wherewithal to change the senate rules regarding the filibustering of federal judges and I don't even know if they have the votes to do that.
As for the notion that the pubbies will reciprocate in kind should a dem President be elected, history says they won't. The left wing media will pound them, unlike the non pounding of the dims, and they will fold if history is any indication.
Of course, if President Bush wins big in 04, everything changes. The dims have a tough road to hoe. They have alienated the south totally and voter registration in swing states is trending pubbie.
All that said, I'm glad to see the pubbies doing something pro-active for a change. Make it a campaign issue and when President Bush wins, he'll have a mandate for putting conservatives on the court.
