Ashcroft will have a hard time getting renominated. Rumsfield might, too, if he is invited back I understand your meaning (though I disagree with you), but I believe the term is "confirmed". Only the President can nominate. The Senate gives advice and consent.

Assuming Bush wins reelection, all of his appointees serve at his pleasure. Ashcroft does not have to go through another confirmation battle unless he goes to another job.
