There is more in the fund than the $50,000 mentioned in an earlier post since many of the legal bills haven't yet been paid. If the mutant gets the remainig cash he gets to pay his lawyer with Terri's money. If he doesn't, he'll have to pay out of his own pocket. So, yes, he's after Terri's trust fund, although, as you stated, the money is not a major worry. I think you misunderstood my point. If he's raided the trust fund, I would think that could make him legally guilty of attempted murder.
