This is one of the dumbest, most irrational statements that I have read on FR in at least a week.
First, violent criminals are not dissuaded from criminal activity because of the legal ramifications of their criminal acts. If that were the case, then strict gun control might actually deter criminals from using firearms to commit violent crimes. It does not and nor does the death penalty.
Second, New York still does not have the a death penalty, and yet the homicide rate in NYC is one of the lowest of any big city in the Country. Indeed, the homicide rate in NYC is significantly lower than most of the largest "death penalty" cities like Dallas, Houston, Jacksonville, Miami, St. Louis, Kancity City, New Orleans, Tulsa, Toldeo, etc. One of the main reasons why the NYC homicide rate was so high under Cuomo is not because he vetoed the death penalty, but because he closed and downsized the state's psychiatric institutions, which resulted in the release of thousands of violent nut jobs who eventually found their way back to NYC.
