Prisoner Sues Over Secondhand Smoke

SANTA FE, N.M. -- A former Santa Fe County Jail prisoner alleges in a lawsuit that he was subjected to cruel and unusual punishment from secondhand smoke in the lockup.
Ethan Roberts said he was forced to breathe smoke from the cigarettes of other prisoners. He's sued the jail's former manager, Cornell Corrections, seeking $1 million in damages. A Cornell spokesman said Monday he couldn't comment on the lawsuit because he hadn't seen it.
Roberts filed the lawsuit last week in state district court in Santa Fe. He was in the jail from April 16, 1999, to June 8, 2000. The lawsuit said he's now an inmate at a federal penitentiary in Big Spring, Texas.

Ethan Roberts said he was forced to breathe smoke from the cigarettes of other prisoners. Must be one of the few jails where inmates are still allowed to smoke. Smoking has been banned from most jails and prisons.
Colorado executed murderer/rapist Gary Davis in 1997. His last request was not a meal but a cigarette. This request was denied because Colorado prohibits smoking in correctional facilities.
To deny a condemned man, regardless of his crime, a final cigarette before his execution is barbaric.
