The famed tobacco whistle-blower detects a whiff of smoke on a visiting photographer and holds out his hand. He gets them, a pack of Salems. They are ''a donation,'' destined for the trash can in Wigand's oceanfront condominium.

The photographer wasn't smoking at the time, and he let's this guy confiscate his cigarettes like a Dutch uncle? I wouldn't have... Oh yeah, I've seen his picture, and he's no Russel Crowe.

Nothing is worse than a non-smoking smoker. This guy is just *dying* for a cigarette, and because he won't allow himself the pleasure, he wants to make sure no one else is allowed to seek satisfaction. I've seen this bit of theatre played out hundreds of times. Sanctimonious hipocrits, all of 'em.

There are people I have known that smoked well into their 80's. There have been young people who died of heart problems and cancer that never smoked. Life's a crapp shoot. But definitely you will die.

It's also demonstrably false. Smoking increases your chances of developing certain heart and/or lung diseases. It doesn't guarantee you'll develop them.

It's also a misdirected argument - a straw man. There are NO valid studies which prove secondhand smoke is harmful. There are plenty that say it isn't. And that's what this supposed ordinance addresses.

It addresses it on the basis of hysteria, junk science, lies, and contempt for property rights.
