Why was it that some people in Texas could engage in sodomy without fear of the law, and others not?

Austin Texas has an active and vocal gay community. Maybe its the lesbian sherriff. Maybe its the former state rep who is openly gay. Maybe its the ... seriously, real fear of a law that hasnt been enforced?

Nobody is mentioning the fact that this law was overturned by a succession of suspicious events, ie, police called on a burglary charge and find men going at it. Then it gets passed into the courts, and the activist groups are thrilled to have a 'test case' so they can 'go after' this unenforced law.
