Enhanced Border Security and Visa Entry Reform Act of 2002 (Engrossed House Amendment)
SEC. 607. EXTENSION OF DEADLINE FOR CLASSIFICATION PETITION AND LABOR CERTIFICATION FILINGS.
(a) IN GENERAL- Section 245(i)(1) of the Immigration and Nationality Act (8 U.S.C. 1255(i)(1)) is amended--
(1) in subparagraph (B)--
(A) in clause (i), by striking `on or before April 30, 2001; or' and inserting `on or before the earlier of November 30, 2002, and the date that is 120 days after the date on which the Attorney General first promulgates final or interim final regulations to carry out the amendments made by section 607(a) of the Enhanced Border Security and Visa Entry Reform Act of 2002; or'; and
(B) in clause (ii) by striking `on or before such date; and' and inserting `before August 15, 2001;';
(2) in subparagraph (C), by adding `and' at the end; and
(3) by inserting after subparagraph (C) the following:
`(D) who, in the case of a beneficiary of a petition for classification described in subparagraph (B)(i) that was filed after April 30, 2001, demonstrates that--
`(i) the familial relationship that is the basis of such petition for classification existed before August 15, 2001; or
`(ii) the application for labor certification under section 212(a)(5)(A) that is the basis of such petition for classification was filed before August 15, 2001;'.
(b) EFFECTIVE DATE- The amendments made by subsection (a) shall take effect as if included in the enactment of the Legal Immigration Family Equity Act (114 Stat. 2762A-142 et seq.), as enacted into law by section 1(a)(2) of Public Law 106-553.
Amend the title so as to read `An Act to enhance the border security of the United States, and for other purposes.'. LINK
This is the relevant provision of HR 1885 to Section 245(i) of the Immigration and Naturalization Code. All it does is extend application deadlines under 245(i).

INS Memo: Sec. 245(i) filingsSection 245 of the Act allows an alien to apply for adjustment of status to that of a lawful permanent resident (LPR) while in the United States if certain conditions are met. The alien must have been inspected and admitted or paroled, be eligible for an immigrant visa and admissible for permanent residence, and, with some exceptions, have maintained lawful nonimmigrant status. The alien must also not have engaged in unauthorized employment. Section 245(i) of the Act allows an alien to apply to adjust status under section 245 notwithstanding the fact that he or she entered without inspection, overstayed, or worked without authorization. Last week's 245(i) extension was specifically about illegals. Letting Illegals stay = Amnesty for those Illegals.

How Do I Benefit From Section 245(i)? (from INS website) Our immigration laws allow qualified individuals to enter the United States as lawful permanent residents ("green card" holders) after they obtain immigrant visas from a consulate or embassy outside the United States or, for many immigrants already lawfully in the United States, through a process called "adjustment of status." If you entered the United States unlawfully, if you entered with permission but did not stay in lawful status, or if you worked without permission, you normally would have to leave the United States in order to apply for an immigrant visa. Special rules under section 245(i) may allow you to apply to adjust status without leaving the United States.
You might need section 245(i) if you:
- Entered the U.S. without being inspected by an INS official.
- Stayed in the U.S. longer than allowed by INS.
- Entered the U.S. as a worker on an aircraft or ship (crewman).
- Entered the U.S. as a "Transit Without Visa."
- Failed to continuously maintain a lawful status since your entry into the US.
- Worked in the U.S. without INS permission.
- Entered as an "S" nonimmigrant (relates to witnesses about criminal or terrorism matters).
- Are seeking a work-related visa and are out of status at the time of filing the application to adjust status (Form I-485).
- Worked in the U.S. while being an "unauthorized alien."

Again, what we see here are more instances of how Section 245(i) applies specifically to Illegals. Extending a deadline for Illegals to "adjust status" means that more Illegals will be staying in the U.S., but they will be legalized for a fee of $1,000. That's Amnesty. Some, I'm certain, will prefer not to believe their lying eyes.

I dont get any orders from Bush but I would be proud to do so. I would be totally ashamed to carry water for Xenophobics like Buchannan or Tancredo. Ah, the ol' race card. Nothing like reaching into that DemocRAT bag of propaganda tricks when you are lost for answers. Uh Dave? For your info I am not a Buchannan supporter though I agree largely with his positions on immigration.
Second, Tom Tancredo is one of the few congressmen in America that has the GUTS and INTEGRITY to tell it like it is on the subject of ILLEGAL IMMIGRATION. In other words, he in not in the pocket of the business lobby that has a vested interest in illegal immigration like so many of our GOP congressmen are. I guess to you that makes him Xenophobic.
Tell me, does standing up for the enforcement of the immigration laws of this country automatically make someone Xenophobic? If so, which laws can I safely ignore if I dont like the law?
Third, not only did I vote for GW Bush, I campaigned for and financially supported his presidential run. Don't believe me? Do an archive search on my posts during the fall of 2000.
Do you have any other smears you want to throw my way?
BTW, you never did answer my question from yesterday. Let me try again: Are You In Favor of Illegal Immigration? It's a simple question Dave. One which you seem to answer in the affirmative only by your shameless defense of the Mexican Invasion which is turning many parts of America's Southwest into a 3rd world country. Come clean Dave.

I have yet to see anything posted here in the actual wording of the bill that says anything you folks say its saying. We already did...NUMEROUS TIMES and on different threads. You and your fellow Bushbots don't want to accept the plain english wording of the bill that clearly states that 245I extends Amnesty to Aliens that entered this country ILLEGALLY. Your inability to come to grips with this is something past denial.

Are the "sponsors" going to pick up the bills for medical care, welfare, schooling for the kids, welfare, incarceration, etc.? If not, why should Americans have to pay for it? You know what janet, I would rather see an immigrant with a wife and family at home busting his ass doing a hards day work bussing tables, putting on roofs, or cleaning toilets, getting a subsidy for healthcare than some cracker drug addled single welfare mom sitting on her ass 18 hours day getting everything handed to her on a platter.

You got that right. I see people on a daily basis that are US CITIZENS hauling their kids around by the elbow because they're too damned lazy to get a job. So what do they do? They have MORE KIDS. Then they want money; and free healthcare, and free food, and free that and free this. I want to give them free birth control, is what I want to give them. Not to mention a kick in the BACKSIDE.

I just got off the phone with Sears and they said they'd install a 12 footer with a razor wire top for not much more than that.
They said they'd give us a good deal on a 24 hr service contract, too. All the border patrol has to do is report any holes and a Sears truck will be down there pronto.
They'll let us charge it, too.

You refer to illegal aliens as "immigrants". How politically correct of you. I'm not in favor of my tax dollars going to any illegal aliens, no matter how you like to characterize them, or to crack addicts either. My question is, why are you so willing to pay for social services to illegals? Or would you be one of those who might benefit from 245i? Just wondering.

Gee, why dont you just admit your against any immigration and its not this bill that you are against. Aren't you projecting a little? Maybe A LOT! When I first read this I thought it was something that came out of Bill Press' mouth. From what I have seen of your propaganda, and that's what it is, anyone that is against illegal immigration is against all immigration. Projecting an opposing argument to the extremes is one of the oldest propaganda tricks in the book. It also symbolizes the desperate tactics of someone that cant successfully argue their case using compelling reason and facts.

OK, I'll "admit it". I have no reason to make "it" a secret. I am against our out of control immigration system. But I am not against ALL immigration. I am against uncontrolled mass immigration and unsecured borders. I am FOR better immigration.
Legal immigration has been at the highest levels in history for the past decade. This is a known fact. No one's quite sure how much illegal immigration there has been, but the census department thinks there are 8-11 million illegal aliens in this country today. That means around 3.5% of the population are foreign nationals with no permission to be in the US. That's a lot. And its easy to confirm that basically anyone can walk into the country over the southern or northern border, or land at the airport and falsely claim political asylum and walk away.
All this means that we are headed for a serious overpopulation problem. The America that welcomed ~10 million immigrants in 1900-1910 had a population of less than 90 million. Today we have a population of 289 million, with the same habitable land area. And in 1990-2000 our population grew by 32.3 million - the most in history - mostly attributable to large-scale immigration:

It also poses a real threat of cultural and political balkanization. This country has traditionally been able to assume a fairly stable cultural base, which kept the population cohesive. We didn't have problems like Canada with their French-speaking province, or the former Yugoslavia with their disastrous mix. We had the historical melting pot and it seemed to work. But the incoming numbers in the past 10+ years have been so huge that the melting pot has overflowed and is not up to the task. At the current rate there is a serious future risk (IMHO) of the American identity being overwhelmed and broken apart.
And - it should go without saying - the fact that our immigration/border control system is totally incapable of keeping track of what's going on means that we will all be vulnerable to terrorists until the system is fixed. I am NOT saying terrorists = immigrants!! But these are issues that share similar causes. One implication of this is that as long as we can't even come close to keeping terrorists out, the gov't will impose an increasingly oppressive police state to make the sheeple feel safe.
I am for reduction of legal immigration to less than 200,000 per year. I am for stopping illegal immigration. And I am for sound and credible borders to protect us.
