Charging you out-of-state tuition if they give in-state tuition is illegal under the 1996 Immigration Reform law. This is the straw that Gray Davis has been holding against such a law in California.
I don't know the procedure, but a lawsuit under the federal act would most likely go in your favor. When Davis signed AB540, it contained a contingency fund for the liability.
Would make for an interesting class action. Force the states of Texas, Utah, and California to refund the difference to every citizen who was forced to pay out of state.
I was definately too hasty in making my prevoius post. I did a search and found 4 articles that told of laws granting illegals in-state tuition (Nebraska, Nevada, Washington, New York State). Three of them read that the law was defeated and the NY one,
here, describes a law suit, filed by illegals, lost due to the 1996 act. Thanks for the correction.
