we were the only ones in the place, it was late....we were put in the non-smoking section...... another party comes in...yes I could get up and leave, forcing the others with me to be uncomfortable....I prefer a legal remedy....nobdy gets to make other people sick just for their good time...

If they were smoking in a non-smoking area you should have asked them to move, that is a legal remedy. They shouldn't have been smoking in that area, I wouldn't do that to someone who specifically sat in a non-smoking area.

You don't own that restaurant - if your smoking friends are willing to sit in the non-smoking section why didn't you just go to a non-smoking reataurant?

Your position ignores simple premises of things like private property rights and personal responsibility.

Talk to the owner of the business - don't promote more government intrusion on small business persons.
