intends to do harm. If you parked your car with the doors open indending on it getting stolen to collect insurance proceeds you are a criminal. If you, unintentionally leave you car door open you are negligent. The one who steals your car is the thief. It's a simple concept and the basis for American criminal jurisprudence.
