I thought President Bush did recess appoint Eugene Scalia and Otto Reich. And the Dems promptly had kittens over that fact.

He did make those appointments, and the fact that you didn't hear any liberal howls shows how little traction the liberals have on this issue. That's why the second wave of recess appointments will be seen as old news by the electorate.
