I'd say it's mostly volume in your example (because there is nothing offensive about Flintstones or country western but volume), but it's content as a general rule. Okay, no volume. My neighbor has a hemomgous porn collection. He's told me about it. He's a creep. Now are we still concerned with the substance of his "violation"?

I don't see a violation if he merely told you the porn collection exists. If he beams its content into your living room (through whatever technical means as long as you can't turn it off) then I see a violation, yes.
