As far as your question is concerned: Can Bush re-instate an administration official by recess appointment when the next congress is seated? Yes, I believe he can. Didn't Clinton do that with Bill Lan Lee? I think that he was the beneficiary of 2 consecutive recess appointments -- that is if I remember correctly!

Well then, it appears Scalia and Reich will at least serve the 8 years while Dubya's in office.

Sorry, you don't remember correctly. See post #132. Lee was appointed in an 'acting' capacity.
