Excellent news. If I can find a little time, I will file an Amicus Brief with out local Court of Appeals on this, if Mike Allen really does appeal.

State supreme courts are elected. They aren't demigods with lifetime tenures like the US Supremes think they are. They will be watching the progress of the case through the courts with an eye to how popular the judges ruling is among the electorate. This is going to the next level in an appeal before making its way to the state supreme court level. The prosecutor is subject to the AG of the state who may or may not continue to support his appeal effort.

The state legislature is in the mix as well and could be pressured to repeal the law before an appeal could work its way through the courts. State laws are not lightly struck down, any more than federal laws are. It won't be an easy process for the prosecutor. Let's say that I'm speaking hopefully.

Bad news bump - there was almost immediately after the ruling an emergency stay put in place by the First District Court of Appeals to prevent the ruling from taking effect. Another hearing is scheduled for January 22.
