jwalsj07, thanks for digging that up - I will blush and admit to actually believing something in the news media without further review and research, something experience should prevent me from doing - however, without seeing the section of the National Security Act of 1947 into which this section was inserted, it is difficult to determine how mandatory it is to notify Congress on these matters - this seems to be more a description of the method rather than the requirements:

(b) FORM AND CONTENTS OF CERTAIN REPORTS- Any report relating to a significant anticipated intelligence activity or a significant intelligence failure that is submitted to the intelligence committees for purposes of subsection (a)(1) shall be in writing, and shall contain the following:

I agree but W was being accused here of breaking the law based on exactly what I posted, an amendment to the "rules" for reporting. Its not the Bushies who are sheep its the anti-Bush reactionary types who graze on liberal press.
