I agree, but I'll lay you 10 to one odds that he's convicted. Whether the law is unconstitutional or not, it's the current law, and the jury must either enforce it or nullify it with an acquittal. The odds favor enforcement. I can appreciate what these guys are doing, but what sense is there in going to jail? He can't challenge the law unless he is arrested and convicted, or the trial judge overturns the law, like the Federal Judge in the Emerson case did with the Lautenberg domestic violence Law. The path to protection of rights can lead through the courts as well as the legislative process.

Interesting. I would not have gotten angry, but I also would never have come back. And that certainly would've been your right.

How is dealing with local issues and a local law taking away from CCW? Give me a break.

Is there any chance that a right to carry law could pass in Colorado? Not after Columbine.
To: El Gato
But not a state-wide one!

Punish the criminals for using firearms illegally, not punish the law-abiding citizens for not committing a crime. Our Constitution protects the rights of "We the people", not removes them.
Can you imagine the outcry if you had to have a permit to speak, or to write, or even to type something on the internet?

What about when the law openly forbids the carrying or even owning a weapon? Should one follow the law then? Just when is it acceptable to stand up for what you believe in, under your views? Once you can't defend them and are under a dictatorship?

great point...nuts like this would have applauded Rosa Parks going to jail for 10 years or something.

"Presser" did not address the issue of whether the Second Amendment applied to the states, although the gun grabbers like to pretend it did. Your quote from "Presser" indicates that as originally passed it did not, and that is still (in 1886) does not apply to deprivation of the RKBA by private citizens, and such protection is the resposibility of the states, if they choose so choose. (Extending the quote just a mite). However since the issue of whether it now applies to the states, through the 14th amendment, was not addressed. The quote would seem to imply that the second only applies to the second amendment, but that is mere dicta, since it was not necessary to the decision that it did not apply to actions of private citizens.

So you mean it is now Constitutional for the local governments to abuse Constitutioal rights? Wonder when that happened.

"Never mind, dopes like this belong in jail." Don't forget that Martin Luther King has major streets and highways and holidays named after him.

A trial judge can overturn a law?

"Local Laws CANNOT supercede the BILL OF RIGHTS..." The Village of Morton Grove, Illinois, has a local ordinance that forbids possession of a handgun inside the Village boundary---the U.S. Supreme Court denied cert.

The 14th Amendment was ratified on July 9, 1868.
Presser was decided in 1886.
Do the math.

"I don't think stunts like this promote the right to bear arms." -- MississippiMan This wasn't a stunt. This was a demonstration towards your stinking government about the non-constitutional nature of laws; soon to be over.
You might be a fine American and I praise you for your work BUT America is not what you think it is anymore. I applaud fine Americans, everywhere for standing up to their constitutional responsibilities.
