Only problem with that theory is the USA never recognized the Taliban as a legitimate government.

However, Walker did serve in a foreign military, whether or not we recognized the government. Someone could serve as a mercenary for a rebel army and face a similar sanction, even though the military in which they were serving was not part of a recognized government.

I've said it before, but I think the most likely thing to happen with Walker is they'll keep him in custody for a couple of years, and then be forced to release him (his daddy can afford the high powered lawyers). He will return to America, write a best selling autobiography, then hit the lecture circuit. He'll wind up being some Islamic studies professor at Berkeley.
