How do we know they are terrorists or war criminals when they haven't even had a trial?
That's the information that comes out at the tribunal. How officials received that information is WHY the suspect must appear at a secret trial/tribunal. Otherwise, the lid would be blown off our intelligence gathering agencies and American citizens put in danger. And not just citizens in military and spy agencies. Every government employee working in whatever jurisdiction picked for such a "trial" would become the target of terrorists. Where do YOU live, maybe YOUR county courthouse will volunteer first???
