I'm no lawyer, but I read some of the history on it, and I think the argument that it was never ratified is completely bogus. Isn't the Equal Right Amendment still hanging out there in limbo for the lack of states that have not passed it? Do we need the lower courts and the Supreme Court to pass it? I never seen where they come into the equation of a state vote.

No. The ERA was sent to the states in March, 1972. The original seven year deadline was extended to ten years. It expired unratified in 1982. No limbo about it, it's dead as a doornail. Any future attempts to pass it has to start from scratch.
