adultery: voluntary sexual intercourse between a married and someone other than his wife or between a married woman and someone other than her husband.

When that law was written, who knew that we would be faced with a world that would accept homosexual relationships the way the they are today? But common sense should apply to the law shouldn't it?

"NH divorce law states that he comes out on top if she engages in "adultry." In other NH laws, adultry is defined as "sexual intercourse." Maybe the court just took the standard definition of sexual intercourse, which is "coitus," and that doesn't happen in lesbian sex.

In that case, you don't have judicial activism because according to the law she didn't commit adultry. Thus judges were being judicially conservative because they didn't effectively rewrite the law to include what it doesn't explicitly include as written. It's up to the legislature to close this rediculous loophole by broadly defining adultry in the divorce law."

You're only looking at one of the defintions...

Main Entry: sexual intercourse
Function: noun
Date: 1799
1 : heterosexual intercourse involving penetration of the vagina by the penis : COITUS
2 : intercourse involving genital contact between individuals other than penetration of the vagina by the penis
source: http://www.m-w.com/cgi-bin/dictionary

Perhaps the judge didn't have access to an internet dictionary.

Liberals say abortion has been put to a vote: Congress defers to the Court's Roe v. Wade and Doe v. Bolton decisions, and as the debate goes on, the abortions do also. Apparently many ignorant "pro-life" people vote for candidates in both parties who support abortion. Shocking!!!!

Priests are supposed to be sexless, right? Those celibacy vows really level the field between gay and straight priests, do they not?

I realize you've joined FR just today, so perhaps that explains why you've misinterpreted the whole N.H. gay priest issue. We're talking about the Episcopal (or Anglican) Church, not the Roman Catholic Church. The former permits priests to marry. But I think you must have known that.

If a married woman has sex with another woman, is that adultery? The New Hampshire Supreme Court says no.

The judges can eat it.

This has nothing to do with gay sex and everything to do with finding any excuse to favor the woman in divorce proceedings.

We need to recall some judges across the land where they can be recalled.

No sherlockless, I live in California where they are very open.

What was interesting was the exodus from California to those three states. I knew something was attracting them, and I found out on Free Republic this past year re the laws and special deals.

I have been warning about the gay agenda since the 1980's when the aids epidemic started.
