If he hasn’t been excommunicated he is indeed a Roman Catholic.

And if he had been excommunicated, he would still be a Roman Catholic. Excommunication does not undo baptism. An excommunicated Catholic is a bad Catholic, at least objectively in a state of sin, and certainly forbidden from receiving the sacraments, but he remains a de jure Catholic.
