You are right, people can move to a state that has more or less religious freedom if they do not like the one they are in.

Which in itself put control on the religious laws which they made, because no state wanted to lose citizens.

And as you pointed out the 14th amendment came out after it was fairly plain that it was not even needed.

no where else to go.
