This definitly clips the prosecution of rush for "effect". Remember drug court only yields a dismissal. The premise of the drug court is to force a defendant to treatment. Here the prosecutor has no cause to force him to drug court.
HOWEVER, the NE is NOT off the hook. Should he be able to correct and show the malicious misrepresentation of the story by the NE, they are toast.
If he can show extortion, that would be outside the immunity deal.
Last these are prescription drugs. I know of one woman who must take oxycotin every day in order to function. If the pain can not be addressed, it literally may be impossible to stop taking the pills.

And very sad.
