If he's convicted, you can bet that will be appealed. I have no doubt he will face her during the trial when she testifies so he has no basis for an appeal. If it becomes a 'he said/she said' the jury will have to determine which one is more credible and he too may be forced to testify.

He will appeal to test that Colorado rule; no other state has a law like that.
