I don't know if it was designed to fail--I do think that some folks in the CRA (and other places) would not have been heartbroken over its failure.

Chief among them was the Republican party apparatus in the first month of the campaign.

Remember they were fearful that they would be blamed (and they were and still are) and many prefered that Davis stew in his own juice when the courts rejected the little borrowing scheme and the roof fell in on Davis' head.
