Stupid parent wanting to sue. He's an idiot. but so is this substitute teacher imo.
She has no right to make the child feel less American for not wanting to say 'under God'. It is people like her that are aiding the problem on the other side. The whole point is that I may say it 'under God', but you don't have to! Since the majority of people are christians in this country, they should be allowed to express their christianity without fear of a governement penalty for it.
If any given community is predominatly christian, they should be allowed to post the ten commandments if they wish, in a courthouse, schoolyard, park or anywhere else their children might go. But if you are athiest, you shouldn't have to suffer a county employee's penalty either, for not participating in a prayer, or the words 'under God'.
I'm almost suspecting this substitute is working for the side of the American Athiests Assoc.

You are right the One World Socialist Fascists are determined to destroy our democratic capitalist system by degrading our Judeo-Christian moral underpinnings. The fascist left know that the only way to convince the people to subjugate their free-will to the government elite is by convincing them that the gov't is the only one who can take care of them and answer their prayers, so to speak.
It is very difficult to subjugate a people who answer to a higher authority than the state. Judeo/Christian religion is anathema to socialist fascism, so they are working over time to try to replace traditional religion with the humanist cult of the environment. We are going to have to work overtime to stop them.

It does say substitute teacher. He/she may not be aware of the new state law. NO STUDENT is required to say the pledge. They may sit/stand while others do. Having observed this in the classroom, as a substitute teacher, none of the other students have a problem with this. One child even whispered to me that it was religious for this child to not say the pledge. It really does not matter to me, personally. The law allows non-participation.

Abilene is home to Dyess Air Force Base. There are also a lot of hispanics in the area. For it to go to this extent, I would like to know why the family is so upset. Were they looking for an excuse to sue over this?

Nowhere does the article state the girl's or her family's other beliefs. Maybe they're not even atheists. It also doesn't state their political positions. For all you know, they might be conservative on every other issue.

Several things. First of all, why the hell is President Bush named in the suit? I've even thought it over for a few minutes to make sure I didn't miss anything, and nope, I still can't think of a good reason to name the President in the suit.
Why congress? Read above.
As an atheist, this is just silly. It's a nuisance suit.
However, the parent should have rode the school to ensure that the substitute never substituted again. That was a totally uncalled for verbal attack on an 11 year old girl by an adult. ...but the sub isn't named on the suit? This smacks of agenda.
Now back to countering jerks who claim I have no right to be here.

I>I have no idea. Personally, I would have gone to the Principal of the school, then the School Board, and pointed out the law in this matter. I would give them a chance to clarify their policies and would have insisted that all teachers, regular and substitute, be instructed in that law. If rebuffed by those, then I might consider a lawsuit, as a parent, but only to force the school to recognize that nobody may be forced to say the Pledge of Allegiance. That's already been decided, way back in 1948.
Just for your information, Texas has a new law that requires the US and Texas pledge be said every day in school and that a moment of silence be included. The same law makes it very clear that one need not, and should never be forced, to be involved.
The teacher was wrong, the kid probably coached to push the issue, and the parents, asses.
