I don't disagree with you - only repeating what Rush says.
He reminded us about the New Jersey election when Torrecelli stepped down. USSC declined to take the case because it was a state's issue. I don't see how this California recall case is different.
I have no clue...just repeating what Rush thinks about this matter.

giving drivers' licenses to Illegal Aliens. They can only lose more with this stunt. Speaking of SB60 illegal alien licenses, if we can get enough signatures for a referendum this fall, the referendum will appear on the March 2004 ballot. When it's on the ballot, people won't forget that the democrats in the legislature passed and Davis signed the bill. The SB60 referendum will energize the anti-Davis anti-Bustamante crowd.
That is, unless the SCotUS intervenes and the recall special election is rescheduled for this November.
If the election is postponed until March, will Kevin Shelley allow more people sign up to be candidates?

By March over 70% of CA drivers will have been presented with triple car tax bills; over 50% of Californians will have paid them and be looking rebates. In March there will be a referendum measure on the ballot overturning drivers licenses for illegal aliens. There will be even more angry voters drawn to the polls by then.
Recall of Davis= Car Tax Rebate$ will be a real simple concept for voters.

In my honest opinion, I think the 9th Circuit ruling is consistent with
Bush v Gore and should be upheld if the SCOTUS applies that same rationale. Moreover, I think that the SCOTUS will simply affirm in any case just because they won't want to revisit the issues of
Bush v Gore [which they'll have to, in order to overturn].
That being said, the guidance of Bush v Gore that you cannot have voters subjected to differing standards has been unevenly applied by lower courts, to say the very least. Furthermore, many states still have disparate voting systems statewide, and so that's an additional caveat.
It's really up in the air what the SCOTUS might do. It's conceivable that the SCOTUS will take the case and extend the stay indefinitely, even if it rules after Oct 7 [thus allowing this recall to proceed]. It's also conceivable that the Supreme Court will not extend the stay, even if they do take up the case [thus postponing the recall to March].
If I had to guess, they will decline review, but that's a very low confidence conjecture. The case law pursuant Bush v Gore is simply to novel and undeveloped to guess with any great deal of certainty..

Supreme Court Justice Kennedy can issue a stay.....and then the SCOTUS has 48 hrs. to say whether they will hear it or not.
OR.....the Calif SCOTUS can be appealed to...the entire 35 judges who would hold a telephone hearing.
This, according to Judge Napalitano on FNC.
