On a purely legal standpoint, it seems kind of stupid to charge someone with a crime for offering to buy something when there is no crime if they asked for it for free.
Don't get me wrong - completely against prostitution, and even believe that adultery should be criminalized. But the legal analysis is lacking, in this day and (sodomite) age.
